What is a Last Will?
A Last Will and Testament “Will” is a confidential written statement of what a person wants done with their property after they die.
Last Will and Testament Provisions
A Will can appoint a guardian for minor or disabled children, elderly parents, dependent relative, pets… in a fiduciary capacity- as well as give directions to your named executor(s) for how your property should be divided to Beneficiaries.
Drafting a Will
Before coming to the office for a scheduled consultation, at the very least, make a list of your assets (real and personal property) to whom you wish to give, devise and bequeath certain items and manner to divide your property. Download Worksheet for Your Will
For example:
- After my passing, my white gold… ring is to go to my best friend Suzy (because she always admired it…)
- The single (two, three…) family property located at xxx street, Brooklyn, NY is to go to my nephew John… together with all appurtenances and improvements…
- The land in Jamaica, W.I. is to be sold and the proceeds equally divided between my sister Jane’s three children…
- My savings (checking) account #### at xxxxx Bank is to be used to pay for my final burial expenses and xxxx debts. The remainder is to be set aside (invested, held in a trust…) for my granddaughter Jane’s college education. Thereafter, the principal is to be….
- For married persons, “To my wife (husband) if s(he) survives me, I give and bequeath xxxx dollars to her/him. If s(he) does not survive me, said amount is to be…”
You can make any provision you wish; a Will is a confidential document which content is not revealed until you die.
Depending on the size of the estate, provisions for compensation can be made for the benefit of the executors to help relieve them of the financial burden of estate management.
Therefore, you have the freedom to bequeath (or not) to any person of choice, within reason…. Should your survivors have any objections, they can duke it out (litigate) in Probate Court. Can’t please all….

Storing Your Will and Testament
After it has been drafted, the original Will is to be kept in a safe place where it will be easy to get to if it is needed.
The Kings County Court, as well as others, provide space in their vault where, for a reasonable fee, you can file your Will for safe keeping.
What Happens After Death
After death, the Will must be admitted to probate or a small estate proceeding, depending on the size of the estate, before the named executor(s) can follow instructions.
Once confidential, your Will at that point becomes a public document that anyone can see and read.
